The defendant in book banning case is Peter Schiff's dad. You may remember Peter from such Youtube videos as "I told you about the housing bubble" in 2006.

I read quite a bit about Irwin's Schiff's case years ago. He had a strong, compelling case in his favor, but I suppose the main lesson to be learned is that the strength of your case - UNDER LAW - does not matter.
The judge refused to allow Schiff to enter any of his exculpatory evidence - refused to allow IRS code to be heard... refused to allow prior legal precedent to be presented, refused to allow the US Constitution to be cited IN COURT, for chrissakes.
So while I admire Schiff and his determination and moral character, I would not recommend following his advice, for as the Honorable Judge Lloyd D. George plainly showed us, in the courtroom, the judge is GOD.
Laws, precedents and the Constitution are annoyances that will not be allowed in defense.
ESPECIALLY in IRS cases.

The publication isn't banned. Irwin Schiff and two associates are simply banned from selling it and in fact it is currently free to download at Schiff's website along with lots of other stuff he used to sell.

It was overruled by more intelligent judges, I think. I haven't had time to find a follow-up article yet.
But he didn't just want to ban the book, he wanted to force the author to reveal the names of every person who bought a copy also, and turn that information over to the IRS for possible prosecution of tax laws.

The ban only applied to Schiff and his business partners. Others are free to sell his fraudulent books if they feel the need.
